SUSPENSION OF THE CHIEF JUSTICE OF NIGERIA: PRESIDENT MUHAMMADU BUHARI IS THE LAW HIMSELF.
THE RULE OF LAW IS SUBJECT TO PRESIDENT BUHARI.
SHAME UNTO PROFESSOR SAGAY AND VICE PRESIDENT YEMI OSINBAJO.
One thing that annoys me about Nigeria’s intellectuals and human rights activists is their obvious shameful behaviour when it comes to hiding the truth under the carpet when their interests are affected. The worst of these people are those professing to be human rights activists. Before they got appointed into public offices, they would oppose injustice with the whole of their beings. But once they found themselves among the power that be, they would start singing new songs.
Infact, only God knows what will become of me in future in the arena of fighting for the voiceless when I find myself facing the truth and falsehood.Will I still have the boldness to say the truth even to a president of nation? Or will I conform to the Sagayic cum Osibajoic lifestyles of conformism? Only God knows.
But the fact remains that these two senior learned friends are disgrace to the noble profession that I belong. It is either Sagay’s thinking faculty has been blocked or that his hometown enemies has finally caught up with him. For the Professor to have said that President Buhari is right to have illegally and mischievously removed the honourable Chief Justice of the most populous cum great black nation without recourse to the rule of law shows that Professor Sagay that i used to attach great value to, is chronically sick and he is in bondage of conformism and in fact, I can boldly say that he is void of respect for the hallowed Rule of Law propounded by Professor A.V.Dicey and the spirit of Constitutionalism. Indeed Sagay needs deliverance.
Even a young lawyer like me knows that the Constitution is the grundnorm and based on Section1 of the 1999 Constitution of Federal Republic of Nigeria, its provisions has binding force on every person and authorities living within Nigeria.
Has the Professor lost his senses because of money and influence? Is he still the same Sagay i used to read his Law textbooks? This is serious!!!
What does the Constitution say about how judicial officers like the CJN can be removed from offices? What legal effect does the combined provisions of Sections 292(2) ,153 ,158, Parts 1and 2 of the 3rd schedule to the 1999Constitution of the FederalRepublic of Nigeria (as amended) have on the actions of our holier than thou President Buhari as far as the suspension of the number one Judicial officer of Nigeria is concerned? Does the Constitution recognize ‘suspension of judicial officers? Why would Professor Sagay endorse the military approach of the President? Isn’t the President’s style of leadership a threat to all of us? Are we slaves to the President? Is the President indeed above the Law?
These questions and many more should be ringing continuously on the minds of praise singer “Sagay and Osinbajo”.
Well, I am not abbeting or advocating for the CJN whom i see as a bird of a feather with his accusers. He has a lot of questions to answer; no doubt about that.
But can we use illegality to remedy illegality just as the President has done? Are the advisers of the President void of the sound position of the Law on this matter? Isn’t it clear without any form of ambiguity that based on Section 292(2), the inputs of the National Judicial Council, NJC and that of the Senate are potently required before a CJN can be removed from office?
The Constitution is very clear on this. Why would the President who has at his disposal lots of so called great intellectuals like Professors Sagay and Yemi Osinbajo who are both professors of Law and Senior Advocates of Nigeria, still be void of sound counsel?
The point is clear.These so called think tanks only tell the President that does not have listening ears according to statement credited to Amaechi, what he wants to hear. But this act itself shows that Sagay/Osinbajo are evil personified as they are enemies of the President.They are disgrace to our noble profession
Believe me, Osinbajo does not have any pastoral quality. Would Jesus Christ be happy with his conformism? Will Jesus endorse Osinbajo for his psycophantic character.This same Pastor Osibanjo sacked a woman who was working in a ministry relating to Niger Delta just because the lady express her constitutional right.
